Summary
The Lord Chancellor Cottenham's discussion of a cause attached to the court of Vice-Chancellor Wigram in July, 1846, in which the plaintiff obtained an order of course to amend after having been served with notice of motion to dismiss for want of prosecution. The Master of the Rolls (Lord Langdale) declined to discharge the order on grounds of "irregularity", but had no jurisdiction to consider the merits of the action. The case was appealed to the Lord Chancellor and affirmed by him in May, 1847
